There is certainly survival value in a swarm moving well away from its mother colony, and if your garden is big enough, putting a bait hive 100 yds or so away would be a good idea.

Your BKA has no authority to tell anyone not to keep bees. IMO that is a high-handed and unnecessary attitude to take to a potential beekeeper.

The BBKA is now owned by Bayer, and refuse to make any connection between bee deaths and pesticides.

That is simply not true and slanderous to say so - I personally don't agree with the ruling on ...
